Eos said that OraLabs Inc., the private label manufacturer, has agreed to cease selling, and having manufactured for it, the majority of its mounded lip balm products, including all products that incorporate eos’ egg-shape design or patented packaging.
In addition, the agreement calls for retailer inventory of the knockoff lip balms to be sold off or destroyed within several months, according to eos. OraLabs’ Chinese manufacturer of packaging components for the knockoff lip balms also has agreed to stop manufacturing the products, eos reported.
The settlements stemmed from two District Court lawsuits, one in Colorado and the other in Delaware, that were filed by eos and its parent company, The Kind Group LLC. Eos said that it voluntarily dismissed both of those suits.
